All giveaways are free and have no territorial restrictions.
Giveaways conducted through the QRching platform are not a lottery or any other risk-based gambling activity, as participation in the giveaway is free and the prize amount is funded exclusively by the sponsor.

A dynamic giveaway ends after the final winning scan of its QR code, while a classic giveaway ends when its specified duration expires.
If the giveaway ends and not all winners are determined, the early winner determination mode is activated. Additionally, every subsequent QR code scan is a winning scan until all winners are determined.

Individuals from all countries worldwide who have reached the age of 16 are eligible to participate.
Sponsors and QR code providers are not eligible to participate.

During QR code scanning via the QRching mobile app, the platform assigns a sequence number to each scan in this giveaway and checks in real time whether it is a winning scan. If not, the user receives a corresponding notification in the application. If the scan is successful, the user receives a winning notification and must provide their details for prize payout in the application.

All winners are published in the "Winners" section on the official website and in the QR code provider's application.

The winner must provide the data for prize payout within 30 days. If the winner does not send the data required for prize payout within these 30 days, the prize is canceled. After submitting the data, the prize is paid out to the winner through one of the payment systems chosen by them and in the currency selected by them.
Cash payout of prizes is not possible.
Any taxes on winnings in the recipient's country are the responsibility of the winner.
The QR code provider is technically unable to track all possible fees of the payment systems used. For this reason, if a fee is charged by the payment system, it is deducted from the prize.
Prize payout is made within 30 business days after receiving the data specified in clause 8.1 from the winner.
For reasons stated in the sponsorship agreement, the giveaway and its results may be canceled, and the giveaway itself may be declared invalid.

Before using the platform, users agree to the privacy policy.
Personal data of participants and winners of giveaways are used exclusively for the purposes stated in the privacy policy.
The winner has the right to request deletion of their personal data by submitting a written request to the QR code provider, in which case the winner loses the right to receive the prize amount.
The winner’s nickname, the date, and the prize amount are published on the official website and in the QRching app under “Winners.” The published information is anonymous and does not allow the winner to be identified or profiled.

The giveaway and the legal relationships arising in connection with it are governed by the laws of the Federal Republic of Germany. For participants who are consumers, this choice of law does not limit the protection afforded to them by the mandatory provisions of the law of their country of habitual residence, where such provisions apply.
The relationships between the QRching platform, giveaway participants, and other users are governed by the Platform Terms of Use and these Terms of Participation.
The relationships between the QRching platform and giveaway organizers are governed by the Sponsorship Agreement.
The QRching platform is not liable for temporary technical disruptions, interruptions in communication services, or the unavailability of third-party services where such circumstances are beyond its reasonable control. This provision does not limit any liability that cannot be excluded or restricted under applicable law.
These Terms do not limit the participants’ statutory rights or the legal remedies available to them.
The FAQ section provides additional explanations. In the event of any inconsistency between the FAQ and these Terms, these Terms shall prevail.
